General Terms and Conditions (GTC) of DÀNA en voyage
The offer on this website is directed exclusively to customers with Swiss domicile who are over 18 years old.
Scope of application
For the use of this website as well as the business relations between DÀNA en voyage and its customers, the following General Terms and Conditions (GTC) shall apply in the version that is currently available and valid when calling up the website or ordering goods.
The term "customer" refers to any natural person or legal entity that maintains business relations with Dàna en voyage. The General Terms and Conditions, the Terms of Delivery and Payment and the Privacy Policy may be amended from time to time. Dàna en voyage asks you to read these provisions carefully each time you visit the website and place an order for goods.
These terms and conditions apply exclusively. Any terms and conditions that are contrary to, supplementary to or deviate from these GTC must be expressly confirmed in writing by Dàna en voyage in order to be valid. By using this website or ordering goods, the customer confirms that he/she fully accepts these GTC, including the terms of delivery and payment.
Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Offer and prices
Our offers are non-binding in terms of price, availability and delivery times. We ship/sell our products within Switzerland and worlwide. DÀNA en voyage disclaims any liability in case of non-compliance with our terms and conditions. Payments made in violation of our terms and conditions will not be refunded.
The prices quoted by DÀNA en voyage include, unless otherwise stated, the statutory value added tax. Prices are inclusive of 7.7% VAT in Swiss Francs (CHF). Shipping costs, if any, will be charged additionally and are to be paid by the customer. Shipping costs are shown separately in the order process.
DÀNA en voyage reserves the right to make technical changes, errors and misprints. In particular, DÀNA may make price changes at any time and without prior notice. Consulting and support services are not included in the sales prices.
Conclusion of contract
The offers on this website represent a non-binding invitation to the customer to order products and/or services from DÀNA. By placing an order via this website including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract.
DÀNA shall then send an automatic "order confirmation" by email, which confirms that the customer's order has been received by DÀNA. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided that the goods are available. The contract is concluded as soon as DÀNA en voyage sends a declaration of acceptance by email, in which the shipment of the ordered products or services is confirmed.
If it becomes apparent after the conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full, DÀNA en voyage shall be entitled to withdraw from the entire contract or from a part of the contract. If the customer's payment has already been received by DÀNA en voyage, the payment shall be refunded to the customer. If payment has not yet been made, the customer shall be released from the obligation to pay. DÀNA en voyage shall not be obligated to make a replacement delivery in the event of a contract cancellation.
Payment options and retention of title
The customer may use the payment options indicated in the order process. DÀNA en voyage reserves the right to exclude customers from individual payment options without stating reasons or to insist on advance payment.
In the event of late payment by the customer, DÀNA may charge interest on arrears of 5% per year and a reminder fee of a maximum of CHF 20 per reminder. The products delivered to the customer shall remain the property of DÀNA en voyage until payment has been made in full.
Delivery, obligation to inspect, notification of defects and return of goods
Deliveries shall be sent by A Mail Priority or courier service to the address indicated by the customer in the order. Upon shipment, the benefits and risks shall pass to the customer to the extent permitted by law. DÀNA en voyage is not obliged to provide proof of shipment. In case of loss of the goods during shipment, the supplier cannot be held liable.
If the shipment cannot be delivered or is not picked up by the customer, the additional shipping costs and a handling fee of SFr. 20 shall be borne by the customer. A new shipment will only be made after receipt of payment. DÀNA can cancel the contract after a notice of complaint by email to the customer and by setting a reasonable deadline.
The customer is obliged to inspect the delivered goods immediately, at the latest within 5 working days after receipt of the goods (in case of cuttings within 24h after the first delivery attempt), and to report any defects immediately by email (including photo) to ----. After this deadline, the return is no longer possible.
Returns to DÀNA en voyage are at the expense and risk of the customer. The customer shall send the goods in their original packaging, complete with all accessories and together with the delivery bill and a detailed description of the defects to the return address indicated by DÀNA en voyage in the imprint. Returns without prior contact with us will not be processed and will be considered as delivered.
If DÀNA en voyage's inspection reveals that the goods have no detectable defects or that they are not covered by the manufacturer's warranty, DÀNA en voyage may charge the customer for the inconvenience, return shipment or possible disposal.
Liability
DÀNA excludes any liability, regardless of its legal basis, as well as claims for damages against DÀNA en voyage and any auxiliary persons and vicarious agents. The consumption or application of the products offered by DÀNA is at the customer's own risk. Likewise, any responsibility is excluded in case of misuse of the products.
DÀNA en voyage is in particular not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage and pure financial loss of the customer. DÀNA en voyage reserves the right to further mandatory legal liability, for example for gross negligence or unlawful intent.
DÀNA may process and use the data recorded in the course of the conclusion of the contract for the purpose of fulfilling the obligations arising from the purchase contract as well as for marketing purposes. The data necessary for the performance of the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

Further provisions
Dàna en voyage expressly reserves the right to change these GTC at any time and to put them into effect without notice. In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is ZURICH in the Canton of Zurich, unless the law provides for a mandatory place of jurisdiction.
